Bolzano/Bozen Exhibition Center v. Fair Guide
In the future, exhibitors at the numerous events of the Bolzano/Bozen Exhibition Center will remain protected against subsequent orders with Construct Data Verlag GmbH (of Vösendorf, Austria). Upon the petition of attorney Gernot Rössler, who is the president of the Bolzano/Bozen Exhibition Center, Judge Carlo Busato of the District Court of Bolzano, in a preliminary injunction, prohibited the Austrian publishing house from advertising with the names of the Bolzano/Bozen Exhibition Center or the names of the latter’s tradeshow events for its own Internet directory “Fair Guide”.
Construct Data Verlag GmbH of Vösendorf, Austria, the publisher of the tradeshow handbook available on the Internet variously known as “Fair-Guide” or “Guida degli espositori nel Fair Guide” or “The Exhibitors’ Fair Guide” has also achieved dubious renown in South Tyrol/Alto Adige because of its disreputable advertising methods. The trick is always the same:
companies that exhibit at one of the tradeshows in Bolzano are requested to correct their exhibitor information. In good faith that they have to do this for their tradeshow participation in Bolzano, they are subsequently strongly urged to pay up. The fair trade authorities in Italy have already repeatedly looked into the dubious activities of the publisher and have judged the activity of Construct Data to be misleading. In Germany, several courts have likewise recognized the publisher's procedure to be dubious and misleading.
Upon the petition of attorney Gernot Rössler, who is the president of Fiera Bolzano S.p.A./Messe Bozen AG, Judge Carlo Busato of the District Court of Bolzano has brought an end to these pursuits and prohibited Construct Data Verlag from advertising by using the names of the Bolzano/Bozen Exhibition Center or the names of the latter’s tradeshow events, clients, or exhibitors for the tradeshow directory with the designation “Fair Guide”, “Guida degli Espositori nel Fair Guide”, or “The Exhibitors’ Fair Guide”.
This preliminary injunction carries legal force effective immediately.
In his judicial injunction, Judge Busato comes to the conclusion that “Construct Data is using the name rights of the Bolzano/Bozen Exhibition Center and its various events in an impermissible manner in order to carry out its activity to achieve profit which, in addition, is also in competition with that of the Bolzano/Bozen Exhibition Center.” And it is doing this even though it must fully realize that it is advertising using the naming rights of others for its own activity. This therefore consists of the “exploitation of the rights of others for its own advertising purposes, which in addition has also been classified by the Italian fair trade authorities as well as by courts in other EU countries as misleading."
The Bolzano/Bozen Exhibition Center requests that all exhibitors and clients immediately report any violations of this injunction. Under no circumstances should demands for payment by Construct Data Verlag be reacted to.

In the legal matter of Fiera Bolzano S.p.A./Messe Bozen AG versus Construct Data Verlag AG, the appeal instance at the District Court of Bolzano upheld the preliminary injunction by Judge Carlo Busato of August 3, 2007.
With this injunction, Construct Data Verlag was prohibited from advertising by using the names of the Bolzano/Bozen Exhibition Center or the names of the tradeshow events organized by the latter, its clients, or exhibitors for the Internet directory by the name of “Fair Guide”, “Guida degli Espositori nel Fair Guide”, or “The Exhibitors Fair Guide”.
